As a tenant of one of the owners, you are welcome in the complex Medina. To make your stay went well, it is good to take note of the following.
In a building with apartments is a homeowners association compulsory. You are here as a tenant not a member of, but you can get there to deal with.
What is a Homeowners Association?
In a building complex with more than one owner is a Homeowners Association (HOA) required by law. The HOA includes all owners of apartments. Who buys an apartment automatically becomes a member of the association. The owner of the apartment is also a member of the association.
The HOA is responsible for the maintenance of the building. Daily maintenance, such as cleaning the stairwells or elevator repair, as well as major repairs, such as painting the building or insulate the roof. All owners share the cost of maintenance.
Cost of maintenance
The tenant does not pay directly for the costs for the maintenance of your building. This pays the owner of the apartment.
You will indirectly contribute to the cost of your building. These are costs for example:
• the central heating
• the roof gardens of the association
• the cleaning of common areas.
The HOA determines annually the total amount of the service charge. The amount is divided among all owners. Then your owner calculates the costs on to you.
Permission from the HOA in rebuilding
If you want to remodel, you need the permission of the HOA in some cases in advance. This involves a conversion to a common part of the building. For example, if you want to apply a sunscreen. Your owner must make this request to the association.
Sometimes it is only through a vote at the annual meeting of the HOA. In that case, it may be long before you know whether you can start growing.
Questions and requests for repair
Your landlord / owner remains your point of contact for inquiries and requests for repair. Even if a repair is necessary in a common part of the building, such as an elevator or a door.
You call your landlord / owner with a repair request, he / she notifies the applicant to the HOA and the HOA manager.
The HOA is responsible for carrying out the repair.
If repairs or maintenance on the building or green should be performed you are obliged as a tenant to grant maintenance people access to the terrace or balcony.
Nuisance
At nuisance you will first talk with the person causing the nuisance. Does this not work, report the nuisance to the HOA.
Is the one who causes a nuisance tenant, contact should be taken with its owner. The owner remains responsible for the behavior of his or her tenant.
If it is an owner of an apartment, your landlord must do the HOA switch.
Conversely, the HOA can sue the owner of a nuisance tenant.
Bylaws
The tenant is responsible for the proper observance of the rules of procedure. The owner of the apartment is obliged to inform the tenant aware of these regulations. The regulations can also be found here in English.
